Terms of Service — UrbanKit Studio

These Terms of Service ("Terms") govern your access to and use of UrbanKit Studio (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) The Service

UrbanKit Studio provides browser-based tools for planning workflows, including utilities to create public-notice radius mailing lists and generate Avery 5160 label PDFs/CSVs.

We may modify, add, or remove features at any time, and may suspend the Service for maintenance, security, or operational reasons.

2) Your responsibilities

Verify requirements: You are responsible for confirming public notice and mailing list requirements for your jurisdiction, including buffer distances, ownership rules, and formatting.
Right to use data: You must have the legal right to upload, use, and process any CSV/GeoJSON or other data you provide to the Service, and to use any outputs you generate.
No sensitive data: Do not upload or enter sensitive personal information (e.g., SSNs, financial info, medical info). If your data includes names/addresses, treat it as personal data and handle it accordingly.

3) Prohibited uses

You agree not to:

Use the Service in any way that violates applicable law or regulations.
Attempt to disrupt, overload, scrape, or probe the Service or related systems.
Bypass or attempt to bypass usage limits or access controls (if any are implemented).
Reverse engineer the Service except to the extent such restriction is prohibited by law.
Use the Service to process data you do not have rights to use, or to violate privacy rights.

4) Data processing and outputs

For the current MVP, uploaded files are processed in your browser and not intentionally uploaded to UrbanKit Studio servers. Outputs (CSVs/PDFs) are generated by your browser and downloaded to your device.

You are solely responsible for reviewing and validating outputs (including addresses, parcel selections, duplicates, and formatting) before relying on them for notices, mailings, or compliance.

5) Third-party services and links

Geocoding

If you use geocoding features, your inputs (such as an address) may be sent to third-party geocoding providers (for example, the U.S. Census Bureau's geocoding service). Those services are governed by their own terms and policies. We are not responsible for third-party services.

Maps/tiles and open-source software

The Service may rely on mapping libraries and third-party map styles/tiles. Some components are open-source and are licensed under their respective licenses. Your use of third-party services is at your own risk and subject to their terms.

Links to third-party sites are provided for convenience; we do not control or endorse them.

6) Advertising

The Service may display advertisements (including Google AdSense). Third-party ad providers may use cookies or similar technologies according to their policies. See our Privacy Policy for details.

7) Intellectual property

The Service, including its design, text, graphics, and code (excluding third-party/open-source components), is owned by UrbanKit Studio and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms.

8) Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.

9) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, URBANKIT STUDIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

10) Indemnity

You agree to defend, indemnify, and hold harmless UrbanKit Studio from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your data, or your violation of these Terms.

11) Termination

We may suspend or terminate access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect the Service, users, or the public.

12) Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above when changes are made. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

13) Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of laws principles.
