Terms of Service

Note: These are reasonable, conservative default terms for a small software service, written in plain language. They are not legal advice and are pending review by an attorney. If anything here is unclear, contact us before relying on it.

These Terms of Service ("Terms") govern your access to and use of UrbanKit Studio (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1) The Service

UrbanKit Studio provides browser-based tools for planning and property-research workflows. These include utilities to create public-notice radius mailing lists, generate Avery® 5160 label PDFs/CSVs, look up parcels against public county ArcGIS® REST services, and a directory ("atlas") and API of public county parcel endpoints.

The Service is, in substance, a directory and a thin client. It helps you find and query property records that counties and other government bodies publish themselves. UrbanKit Studio does not own those records and does not operate the county servers that hold them.

We may modify, add, or remove features at any time, and may suspend the Service for maintenance, security, or operational reasons.

The Service is intended for ordinary, interactive lookup and export use through the interface we provide. You agree not to:

Where the Service offers a documented API or higher-volume plan, use it within the limits and terms of that plan. Programmatic access outside those documented limits is not permitted.


4) Data processing and outputs

Uploaded files (such as CSV or GeoJSON) are processed in your browser and not intentionally uploaded to UrbanKit Studio servers. Outputs (CSVs/PDFs) are generated by your browser and downloaded to your device. Tools backed by the parcel atlas API (for example bulk enrichment, auto-county radius lookups, and property reports) send the addresses or parcel you enter to UrbanKit Studio servers to run the query, and responses may be cached briefly for reliability and billing — see the Privacy Policy for details.

Property data is provided "as is" from third-party government sources. Parcel records, owner names, addresses, and related fields come from county, municipal, or other public records, served as-is and largely pass-through. We do not create, verify, or warrant the accuracy, completeness, currency, or availability of that data, and a source can change, restrict, or take down its service at any time without notice to us. Our Data Availability Commitment describes the limited operational promise we do make — that we monitor indexed endpoints and disclose when one is down — and is not a warranty of accuracy.

You are solely responsible for reviewing and validating outputs (including addresses, parcel selections, duplicates, and formatting) and any property data before relying on them for notices, mailings, legal compliance, or any decision.


5) Third-party services and links

Geocoding

If you use geocoding features, your inputs (such as an address) may be sent to third-party geocoding providers (for example, the U.S. Census Bureau's geocoding service). Those services are governed by their own terms and policies. We are not responsible for third-party services.

Maps/tiles and open-source software

The Service may rely on mapping libraries and third-party map styles/tiles. Some components are open-source and are licensed under their respective licenses. Your use of third-party services is at your own risk and subject to their terms.

Links to third-party sites are provided for convenience; we do not control or endorse them.


6) Advertising

The Service does not currently display third-party advertising. If we introduce advertising in the future, any third-party ad provider may use cookies or similar technologies according to its own policies, and we will update our Privacy Policy accordingly.


7) Intellectual property

The Service, including its design, text, graphics, and code (excluding third-party/open-source components), is owned by UrbanKit Studio and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose, subject to these Terms.

Third-party trademarks

Avery® is a trademark of CCL Label, Inc. ArcGIS® and Esri® are trademarks of Esri. All other product names, logos, and brands are the property of their respective owners. We name these marks only to describe compatibility or interoperability (nominative fair use); their use does not imply any affiliation with or endorsement by their owners. UrbanKit Studio is not affiliated with or endorsed by any third party or government agency.


8) Paid subscriptions and billing

Some features are offered on paid plans. Paid plans and usage-based charges are processed by our payment processor, Stripe. We do not store your full card details; Stripe handles payment information under its own terms and privacy policy.


9) Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED.

THIS APPLIES IN PARTICULAR TO PROPERTY AND PARCEL DATA, WHICH IS SOURCED AS-IS FROM THIRD-PARTY GOVERNMENT RECORDS. WE DO NOT WARRANT ITS ACCURACY, COMPLETENESS, CURRENCY, OR CONTINUED AVAILABILITY, AND THIRD-PARTY SOURCES MAY CHANGE OR REMOVE THEIR SERVICES AT ANY TIME.


10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, URBANKIT STUDIO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.


11) Indemnity

You agree to defend, indemnify, and hold harmless UrbanKit Studio from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your data, or your violation of these Terms.


12) Termination

We may suspend or terminate access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect the Service, users, or the public.


13) Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above when changes are made. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.


14) Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of laws principles.
